Version 1.4 · effective 23 October 2026
These API Terms apply to your use of the Xclusive VR API, the API dashboard and account page, and the hosted player, streams, cinema and environments (together: the "Service"). The Service is provided by PVG Technologies BV, trading as Xclusive VR, registered with the Dutch Chamber of Commerce under number 99645939 ("we", "us"). By ticking the box when you sign up, or by pressing "I agree" in your dashboard, you accept these terms on behalf of the organisation you represent ("you").
1.1. The Service is for businesses and other organisations, not for consumers. You confirm that you are authorised to accept these terms for your organisation.
1.2. A separate written agreement (for example an Enterprise agreement) takes precedence over these terms where the two differ. Your own purchasing or general terms do not apply.
1.3. The Data Processing Agreement forms part of these terms. Where these terms set different storage periods than the Data Processing Agreement, these terms prevail for the Service.
2.1. You sign in to your dashboard with your work email and a one-time code that we email you. Keep access to that mailbox secure.
2.2. You can add colleagues to your team. They sign in with their own work email. Everything done by people on your team, and with your API keys, counts as done by you. Remove people from your team as soon as they should no longer have access.
2.3. Keep your API keys and any link to your account page secret, and treat them like passwords. If a key may have leaked, revoke it straight away and create a new one. Tell us if you think your account page link has leaked, and we will replace it.
2.4. Keep your billing details and contact email up to date. We send invoices and important notices to that address.
3.1. Before you can create API keys or use the dashboard, you add a payment card. Adding a card does not charge it. We charge it only when you top up your balance, when you switch on automatic top-ups, or when you start a subscription (section 6).
3.2. Sandbox keys are free. Sandbox conversions are simulated and do not produce real 3D video.
3.3. When you add a card, your organisation receives free test minutes once. One card gives test minutes only once, also across different accounts. Conversions paid with test minutes stay available for 14 days.
4.1. Conversions are prepaid. You top up a balance by card, in the currency of your account (EUR, USD, GBP, CHF, CAD, AUD, SEK, NOK or DKK), from the minimum shown on your account page. You choose the currency when you sign up; it is fixed after your first payment. Every top-up comes with an invoice. VAT is added where it applies; within the EU outside the Netherlands it is reverse-charged when you provide a valid VAT number.
4.2. Conversions are charged from your balance at the prices per minute shown in your dashboard. The price depends on the resolution of your video (a short side of up to 1080 pixels, or more) and on the options you choose, such as hosting and the player or a spatial file for Apple Vision Pro. We measure the length ourselves, per second, with a minimum of 30 seconds. Test minutes are used before your balance.
4.3. If a conversion fails, the amount charged for it is returned to your balance automatically.
4.4. Your balance does not expire while your account is active. A balance is not refunded in cash, except where these terms say otherwise or the law requires it.
4.5. If you switch on automatic top-ups, you authorise us to charge your saved card for the amount you chose whenever your balance falls below the threshold you set. You can switch this off at any time.
4.6. We may change our prices with at least 30 days' notice by email. New prices apply to conversions started, and subscription periods beginning, after the effective date.
4.7. Where an optional daily limit is set on your account, we refuse new conversions above that limit until the next day.
5.1. With hosting, the minutes viewers watch your videos in our player, including in the cinema and environments, are counted per calendar month. A number of watched minutes is included each month, as shown in your dashboard (25,000 unless agreed otherwise in writing). Minutes above that cost €1.50 per 1,000 (or the equivalent in your account currency).
5.2. Watched minutes above the included number are charged at the price shown in your dashboard (€1.50 per 1,000 minutes or the equivalent in your account currency, unless agreed otherwise). After each month we take that amount from your balance and email you the details.
5.3. If your balance is too low for that amount, it becomes negative. A negative balance is an amount you owe us. It is settled from your next top-up, and new conversions are paused until your balance is positive again.
6.1. Player Pro is a monthly subscription at the price shown in your dashboard, plus VAT where it applies. It renews automatically every month and is charged to your card at the start of each period. Every payment comes with an invoice.
6.2. If your organisation has never had Player Pro, the first 14 days are free. Your card is charged when the free period ends, unless you cancel before then.
6.3. You can cancel at any time in your dashboard. The cancellation takes effect at the end of the period you have paid for; we do not refund partial periods. Until then you can undo the cancellation.
6.4. If a payment fails, our payment provider tries again and emails you. If the payment still fails, Player Pro switches off and your videos play in the standard player again.
6.5. The cinema and environments are made available inside our player only. You may not copy, extract or redistribute them, or use them outside the Service. Credits for third-party materials shown in the player must remain visible.
7.1. You keep all rights to the videos you send us and to the converted results.
7.2. You confirm that you have all rights and permissions needed for the videos you send, including copyright and the consent of people who can be recognised in them, and that the videos and their use do not break the law. You indemnify us against claims from third parties that arise from the videos you send or from how you use the results.
7.3. You give us permission to process your videos only to provide, secure and support the Service, as described in the Data Processing Agreement.
7.4. Anyone can report a video we host that they believe is illegal or infringes their rights, through our report form. If we find that a hosted video breaks the law or these terms, we may take it offline. We then email you which video it is, why, and how you can object; if your objection holds, we put it back online.
8.1. You can connect your own storage (for example an Amazon S3, Cloudflare R2 or Backblaze B2 bucket) so that we deliver the converted files there. You give us credentials for that storage; use credentials that can only write to the bucket or folder you choose.
8.2. We store these credentials encrypted, use them only to write a connection test file and your converted files, and never show them again. You can remove the connection at any time, which deletes the credentials.
8.3. You are responsible for your storage, including its security, availability, costs and the files once they are delivered. We check that each file arrives complete, but we are not responsible for what happens to it in your storage.
8.4. If delivery fails, we try again and tell you. Your files then stay available for download as described in section 9.
9.1. A converted file can be downloaded for 30 days after the conversion is completed. If we delivered it to your own storage and you did not choose hosting, we delete our copy 30 days after delivery.
9.2. With hosting we keep the video and the player online for 12 months after the conversion is completed. After that the hosting renews for one year at a time, at the renewal price per video minute shown in your dashboard (lower with Player Pro), charged from your balance the day before the end date. We email you at least 30 days before. You can switch renewal off per video at any time before it renews; the video then goes offline on its end date. Videos made with test minutes are not renewed.
9.3. After these periods we delete the files. Keep your own copy of anything you want to keep longer.
10.1. You may build the Service into your own websites, apps and products and offer the results to your own customers.
10.2. You may not use the Service for illegal content, content that sexualises minors, content you have no rights to, or content intended to harass or deceive.
10.3. You may not attempt to get around limits or security, overload the Service on purpose, or reverse-engineer the Service.
11.1. We do our best to keep the Service available and fast, but we do not guarantee uninterrupted availability unless agreed in writing (for example in an Enterprise agreement). We may carry out maintenance, preferably at quiet times.
11.2. The API is versioned (/v1). We announce changes that could break an existing integration at least 60 days in advance by email, unless a change is needed sooner for security or legal reasons.
12.1. You can stop using the Service at any time. A running subscription ends as described in section 6.3.
12.2. We may suspend your account or keys if you break these terms, if an amount you owe us remains unpaid, if there is a security risk, or if the law requires it. Where reasonable we warn you first.
12.3. We may end the Service for your organisation with 30 days' notice. In that case we refund your unused balance and the unused part of a paid subscription period, unless we end it because you broke these terms.
13.1. Our total liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months before the event that caused the claim.
13.2. We are not liable for indirect or consequential loss, such as lost profit, lost revenue, lost data or reputational damage.
13.3. These limits do not apply to damage caused by our intent or deliberate recklessness.
14.1. We may change these terms. We announce changes at least 30 days in advance by email and in your dashboard.
14.2. After a change you need to accept the new version in your dashboard before you can top up, create keys or start new conversions from the dashboard. Existing integrations keep working in the meantime.
15.1. These terms are governed by Dutch law.
15.2. Disputes are submitted to the competent court in the district where PVG Technologies BV has its registered office.
