Terms of Service — XclusiveVR

1. Consent

By using our website or services, you agree to these Terms of Service, as well as our Privacy Policy and Cookie Policy. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years of age and legally competent to enter into this agreement. By using the platform, you confirm that you meet these requirements.

3. Commercial Use

Videos processed through XclusiveVR may be used for both personal and commercial purposes. XclusiveVr does not claim any rights over the final output. However, you are solely responsible for ensuring that you have the necessary rights, including copyrights, to upload and process the video files via our platform. For more details on your responsibilities and the consequences of copyright infringement, see Article 10 (Upload of Content & Copyright).

4. Prohibited Content

You may not upload or process content that:

• Violates any law or regulation

• Contains nudity, sexually explicit material, or erotic content

• Contains violence, hate speech, racism, child abuse, or promotes illegal activity

• Infringes on copyrights, trademarks, or personal privacy

• Contains spam, harmful software, or viruses

We may review uploaded and converted material to check it against these rules. If content does not meet them, we may remove it at any time and without prior notice. Where you paid for a conversion that we remove, the minutes it used are returned to your balance.

Repeated or serious breaches may lead to suspension or closure of your account.

5. Feedback

Any feedback you provide may be used by XclusiveVr on a royalty-free, worldwide, and perpetual basis, without any obligation or compensation to you.

6. Acceptable Use and Fair Use

You may use XclusiveVR for your own videos, including commercially, within the limits set out in these Terms.

Fair use of hosting and streaming:

Hosting and streaming are included so that you can watch and share your own conversions. They are intended for normal personal or professional use, not as a general content delivery network. We may apply reasonable limits, and we may contact you before taking any action if your usage is far outside normal patterns — for example automated or large-scale redistribution, embedding on high-traffic sites, or sustained streaming that is clearly not personal viewing.

What we do with your content:

We process your video to produce the 3D conversion, and we store the result so you can watch and download it. We may review material to check it against our content rules. We do not sell your content, we do not share it with third parties for their own purposes, and we do not use it to train AI models.

7. Minutes

Definition: Conversion is paid for in minutes, bought as a one-time bundle. Minutes have no monetary value and cannot be exchanged for money or other forms of compensation.

What a minute is: One minute of source video, regardless of its resolution or output format. A 90-second video uses 1.5 minutes.

Validity: Minutes are valid for 12 months from your most recent purchase. Buying an additional bundle adds those minutes to your remaining balance and extends the entire balance for a further 12 months from that purchase.

Running out: If your balance is not sufficient for a conversion, that conversion is refused before it starts. There is no overage billing and no additional charge.

Expiry: Unused minutes expire at the end of the validity period and are non-refundable, except where required by law or under our money-back guarantee.

Changes: XclusiveVR reserves the right to adjust pricing for future purchases. Changes never affect a bundle you have already bought.

8. Right of withdrawal (EU consumers)

If you are a consumer living in the EU, you have 14 days from your purchase to withdraw from the contract without giving a reason. You can withdraw by emailing info@xclusivevr.com, or by using the model withdrawal form that EU law provides. We refund you within 14 days, to the same payment method you paid with.

Immediate access: when you buy a bundle you ask us to make your minutes available straight away, and you confirm that you understand what that means for this right. You lose the right of withdrawal for each minute at the moment it is used by a conversion you start. You keep it for every minute that is still unused when you withdraw, and we refund those in proportion to what you paid.

An example: you buy 50 minutes for 29 euro and convert a 5-minute video. If you withdraw within 14 days, 45 of your 50 minutes are still unused, so we refund 45/50 of 29 euro.

This is your statutory right. Our 7-day money-back guarantee below is something we offer on top of it. It never replaces or limits this right, and you can always choose whichever suits you better.

9. 7-day money-back guarantee

On top of your statutory right of withdrawal, we offer a voluntary guarantee that is quicker and needs no explanation from you.

Within 7 days of a purchase you can ask for a full refund of that purchase, as long as you have used less than 20% of the minutes it contained. This applies once per account. Request it on your billing page or by emailing info@xclusivevr.com; we refund to your original payment method within 14 days.

We offer this because we would rather you tested the service on your own video than took our word for it. If it is not what you expected, you should not be stuck with it.

10. Prices, VAT and invoicing

Prices are shown per bundle, as a one-time amount, in the currency you see on the pricing page. Nothing renews and we keep no card on file for later.

VAT: prices shown in euro to consumers in the EU include VAT. Business customers with a valid VAT number registered outside the Netherlands are invoiced without VAT under the reverse-charge rules. Customers outside the EU are invoiced without VAT. The treatment that applies to you is stated on your invoice.

You receive an invoice by email after every purchase. If you need it addressed to a company, add your company details and VAT number in your profile before you buy.

11. Liability and Indemnification

You agree to indemnify and hold harmless XclusiveVr from any claims, damages, or legal fees arising from your use of the service or content you upload.

12. Changes to the Terms

We reserve the right to modify these Terms at any time. The updated version will take effect upon publication. Continued use of our services constitutes your acceptance of the revised Terms.

13. Upload of Content & Copyright

10.1 User Responsibility

You guarantee that you own all rights or hold valid licenses and permissions to upload and process any content via XclusiveVR. Uploading copyrighted material without authorization is strictly prohibited.

10.2 Prevention and Handling

XclusiveVR reserves the right to review, block, or suspend processing of content that is suspected of copyright infringement. We may also request additional proof of rights from the user.

10.3 Consequences of Violation

In the event of copyright infringement, XclusiveVR may suspend or terminate your account, refuse processing results, or remove related content.

10.4 Review and Objection

Users may request a review of a block or removal if they can provide sufficient evidence that they hold the necessary rights to the content.

14. Storage and Retention

Your original uploaded file is deleted within 7 days of processing, whatever you paid.

For paid conversions:

• The full-quality master file is available to download for 90 days after the conversion completes.

• The streamable version stays available to watch for as long as your minute balance is valid, which is 12 months from your most recent purchase.

For free trial conversions:

• The result is available for 7 days, after which it is permanently deleted.

After a retention period ends, files are automatically and permanently deleted and cannot be recovered. It is your responsibility to download and back up anything you wish to keep within the applicable period. XclusiveVR is not responsible for loss of files after these periods have passed.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be submitted to the competent court in Amsterdam.
